Risk Disclosure: Past performance is not indicative of future results. Trading involves substantial risk, and results will vary. Read the full risk disclosure.
This Risk Disclosure is provided by Cash’s Inner Circle LLC (“OpenFlow,” “we,” “us,” or “our”). Read it carefully before purchasing, installing, or using any OpenFlow software, education, or community resource (the “Services”). By using the Services, you acknowledge that you have read, understood, and accepted every disclosure below.
1. Trading Involves Substantial Risk of Loss
Trading futures, equities, options, foreign exchange, and other financial instruments involves substantial risk of loss and is not suitable for every person. You can lose some or all of the capital you commit to trading — and, in certain products and account types, more than your initial investment. You should never trade with money you cannot afford to lose. Before trading, carefully consider your financial condition, experience, objectives, and risk tolerance, and consult an independent licensed financial professional if you are unsure whether trading is appropriate for you.
2. No Guarantee of Profit
OpenFlow does not guarantee profits, income, account growth, prop-firm payouts, or any particular trading outcome. No trading system, strategy, or automation — including the OpenFlow strategy and software — can eliminate risk or assure success. Any statement by any person suggesting guaranteed results is unauthorized and should be reported to us through the official OpenFlow Discord community.
3. Past Performance Is Not Indicative of Future Results
Any performance figures, statistics, screenshots, payout certificates, or testimonials shown on our website or in our community reflect historical results achieved under specific market conditions and specific configurations. Historical results do not guarantee, and are not a reliable indicator of, future results. Market conditions change, and a strategy that performed well in the past may perform poorly — or lose money — in the future.
4. Hypothetical and Simulated Performance Limitations
Some results presented may be simulated, backtested, or otherwise hypothetical, including results generated in simulated (“sim”) or evaluation accounts. In the spirit of CFTC Rule 4.41, we provide the following disclosure:
HYPOTHETICAL OR SIMULATED PERFORMANCE RESULTS HAVE CERTAIN INHERENT LIMITATIONS. UNLIKE AN ACTUAL PERFORMANCE RECORD, SIMULATED RESULTS DO NOT REPRESENT ACTUAL TRADING. ALSO, SINCE THE TRADES HAVE NOT ACTUALLY BEEN EXECUTED, THE RESULTS MAY HAVE UNDER- OR OVER-COMPENSATED FOR THE IMPACT, IF ANY, OF CERTAIN MARKET FACTORS, SUCH AS LACK OF LIQUIDITY. SIMULATED TRADING PROGRAMS IN GENERAL ARE ALSO SUBJECT TO THE FACT THAT THEY ARE DESIGNED WITH THE BENEFIT OF HINDSIGHT. NO REPRESENTATION IS BEING MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFITS OR LOSSES SIMILAR TO THOSE SHOWN.
5. OpenFlow Is Not a Broker, Adviser, or Fiduciary
OpenFlow is a software and education company. We are not a broker-dealer, futures commission merchant, introducing broker, commodity trading advisor, commodity pool operator, investment adviser, or fiduciary, and we are not registered with the SEC, CFTC, NFA, FINRA, or any other financial regulator. Nothing in the Services constitutes financial, investment, tax, or legal advice, an offer or solicitation to buy or sell any instrument, or a recommendation regarding any specific trade or account. The Services are general in nature and are not tailored to your individual circumstances.
6. You Are Solely Responsible for Your Trading
The OpenFlow software executes rules according to settings that you select and control. You are solely responsible for:
- the decision to use automation at all, and on which accounts;
- your account settings and risk configuration, including position sizing, maximum loss limits, session times, and any manual overrides;
- monitoring your accounts and the software while it is running;
- every order placed in your account, whether generated automatically or manually; and
- compliance with all laws and platform rules that apply to you.
No employee, contractor, or community member of OpenFlow is authorized to manage your account, place trades on your behalf, or promise any outcome.
7. Software, Technology, and Execution Risk
Automated trading depends on software, hardware, data feeds, network connections, and third-party platforms, all of which can fail. The software may experience errors, bugs, outages, delays, disconnections, or data-feed failures that can cause missed entries, missed exits, duplicated orders, unintended positions, or execution at prices materially different from those expected. Slippage, latency, gaps, and exchange or platform outages can increase losses. You are responsible for supervising the software, maintaining a stable environment (or a VPS), and having a plan to flatten positions manually if the automation or your connection fails.
8. Leverage and Futures-Specific Risk
Futures and other leveraged products allow you to control a large contract value with a relatively small amount of capital. Leverage magnifies both gains and losses: a small adverse price move can produce losses that are large relative to your account balance and can exceed your deposited funds in some account types. Futures markets can be volatile and can move rapidly, including overnight and around news events, and positions may be impossible to exit at your intended price. Understand contract specifications, margin requirements, and liquidation rules before trading any leveraged product.
9. Prop-Firm and Third-Party Platform Responsibility
If you use the software with a proprietary trading firm evaluation or funded account, you are solely responsible for reading, understanding, and complying with that firm’s rules — including rules on automation, copy trading, drawdown limits, consistency requirements, news trading, and prohibited conduct. Violating a prop firm’s rules can result in failed evaluations, denied payouts, or closed accounts, and OpenFlow has no control over and accepts no responsibility for any prop firm’s decisions. We make no representation that any particular firm permits the use of our software; confirm this with the firm directly before connecting it. The same applies to brokers, exchanges, data providers, and trading platforms generally.
10. Results Vary
Individual results vary widely based on market conditions, account size, configuration, discipline, timing, and factors outside anyone’s control. Testimonials and community posts reflect individual experiences and are not typical; they should not be interpreted as a promise or projection of your results. See our Earnings Disclaimer for additional detail.
11. Acknowledgment
By using the Services, you acknowledge and agree that: trading involves substantial risk of loss; you may lose some or all of your capital; OpenFlow does not guarantee profits; historical, simulated, and hypothetical results have inherent limitations and do not guarantee future results; OpenFlow is not your broker, adviser, or fiduciary; and you alone are responsible for your trading decisions, settings, and outcomes.
